These terms cover your use of this website and any order you place on it. By placing an order you agree to them.
Age requirement
You must be at least 18 years old to buy anything on this site. Kava, kratom and hemp derived products are age restricted. We confirm your age at checkout and we may ask for identification before releasing an order, including at in store pickup. Orders placed by anyone under 18 will be cancelled and refunded.
Where we ship
We ship within the United States only. Kratom is restricted or prohibited in some states, counties and cities. It is your responsibility to know the law where you live before ordering. We may cancel and refund any order going to an address in a jurisdiction where the product is not permitted. In Florida, state law requires the purchaser of kratom products to be 21 or older, and we apply that limit to kratom orders shipped or picked up in Florida.
Products and information
Nothing on this site is medical advice. Our products are not intended to diagnose, treat, cure or prevent any disease and have not been evaluated by the Food and Drug Administration. Do not use if you are pregnant or nursing. If you take prescription medication or have a medical condition, speak to a doctor before use.
We try to keep product descriptions, images and prices accurate. Colors and packaging may vary from the images shown. If a product is listed at an incorrect price we may cancel the order and refund you in full rather than fulfil it.
Orders and payment
Your order is an offer to buy. It is accepted when we send the order confirmation email. Card payments are processed by Authorize.Net. Prices are in US dollars and exclude sales tax, which is added at checkout where applicable.
We may refuse or cancel any order, including for suspected fraud, a pricing error, a stock shortage or a delivery address we cannot ship to.
In store pickup
Pickup orders are held for 14 days. Bring photo identification and your order number. After 14 days an unclaimed order may be restocked and refunded less any transaction fee.
Events, classes and bookings
Class, market booth and food truck bookings are for the specific date you select at checkout. Spaces are limited and are confirmed in the order they are received. Vendor and food truck applications are applications, not guaranteed placements. If we cannot fit you into the date you selected we will offer another date or refund you in full.
Event cancellations by you are covered by our Refund and Returns Policy. If we cancel or reschedule an event, you may take the new date or a full refund.
Your account
You are responsible for keeping your account password confidential and for activity on your account. Tell us straight away if you think someone else has access to it.
Acceptable use
Do not attempt to interfere with the site, access it by automated means, resell our products as your own, or use it for anything unlawful.
Intellectual property
The Kava & Company name, logos, photography and site content belong to us and may not be reproduced without written permission.
Liability
To the fullest extent permitted by law, our liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of Florida, and any dispute will be handled in the courts of Duval County, Florida.
Changes
We may update these terms. The version in force is the one published on this page when you place your order.
